Forex - A Survey Rating Three Top Retail Brokers

Perhaps you are considering or have already decided to enter into the fascinating and potentially lucrative foreign exchange (FOREX) market. You may now be wondering how you should go about choosing one broker over another. As you might guess, each has advantages and disadvantages. This article will help you to explore some of the aspects of doing business with three of the top retail FOREX brokers in the USA.

This author has test-driven the demo platforms provided by these FOREX brokerages. They are Oanda, FX Solutions and InterbankFX. These brokers were chosen for review due primarily to their popularity among retail traders. Some of the basic findings are incorporated into this article. A more extensive coverage of the areas of comparison is beyond the scope of this article. Depending on the individual traders preferences, there is, however, enough critical information supplied here to provide a basis for making an intelligent choice from among the several brokers named.

Cost of Entry
A very pertinent area of comparison is the minimum amount required for opening an account at each broker. Opening a trading account at Oanda requires only $1. Risk concerns aside, this theoretically opens up the window of opportunity to virtually anyone, including those well below the poverty line. Of course, a more realistic view for wealth building would require a substantially higher amount. Financial longevity and successful trading is difficult at such a low level of capital investment.

The minimum amount required by both FX Solutions and InterbankFX for opening a live account will set you back $250.00. Although this is substantially higher than what Oanda requires, most investors would probably want to start somewhere near this level, at a minimum. The rationale for needing a higher starting amount has to do with the potential for draw-downs. A draw-down occurs when your trading position is in the negative because the market is trending against the direction of your profit target. Consequently, the lower your capital investment, the quicker it tends to disappear.

Customer Friendliness
As for rating the customer friendliness of each platform, it appears that Oandas platform may take the top spot. The trading charts are above average and built directly into the platform. Although all of the platforms have quite a few bells and whistles, ease of navigation must be present to win the top spot. For example, if you trade based on the release of certain economic news events, you will undoubtedly find that it takes less time to set up on Oanda than it does on the other two platforms. Time is of the essence in the fast-paced news trading environment. Depending on the type of trader you arenews trader, short-term, long-term, etc.you may not need most of the features offered on any of the three platforms.

Leverage Allowed
Beyond the basics of low-cost account setup and customer-friendly platform, Oanda seems to take a backseat to the other two brokers. This is particularly true in the area of leverage. Leverage is the privilege most brokers give you of trading more money than you actually have in your account. Higher levels of leverage have the potential of boosting your profits tremendously. Quiet honestly, your losses can also be enhanced greatly, if you end up on the wrong side of a trade. Leverage is a two-edged sword. The maximum leverage allowed by Oanda is 50:1, while InterbankFX and FX Solutions allow a maximum of 200:1 and 400:1, respectively.

Spread
All Forex brokers must be compensated for the service they offer in allowing you to utilize their platform to place your trades. Rather than earning commissions, the brokers are paid a spread, which is the difference between the ask and the bid price for the currency pair you are trading. The higher the spread, the more the broker gets paid. Consequently, investors will prefer a broker with comparatively low spreads, all other things being equal. Other than at or near the time of an economic news release, Oanda tends to have lower spreads than InterbankFX or FX Solutions. This advantages lessens around news trading time when Oandas spreads tend to increase dramatically, as does those of InterbankFX. The distinction here goes to FX Solutions, whose spreads are constant, even during news time, and only slightly higher during calmer market conditions.

Connectivity
Finally, connectivity issues must be taken into consideration.. It appears that the Oanda platform is the most problematic, time-wise and technologically, when new users are attempting to connect. Some users attempting to go at it alone, without the assistance of tech support, find it difficult, if not impossible, to connect before finally being informed by Oandas tech support that they needed the latest version of Java to access the platform. Oanda also seemed to have the greatest likelihood of users being disconnected during high-traffic times, such as during major news releases. Of the three, FX Solutions seems to be the most stable, with little or no known instances of major disruption. Past problems with InterbankFX users being disconnected during high traffic conditions seem to have been successfully addressed by the broker.

In the end, the trader must decide which issues are of priority concern and choose accordingly. By the way, there is no law, rule or policy which would prohibit a trader from having accounts at more than one broker. Such an arrangement may allow the trader to take advantage of the various profit opportunities, based on the strengths and weaknesses of each broker.

    Note that you are looking for a great home inspector. A home inspection is truly only as good as the inspector conducting it. You should take hiring a home inspector as seriously (or more so) than youd take hiring any other professional who has your life in their hands. They may actually have you familys safety in their hands, depending on how good they are at finding problems associated with properties.

    Home inspectors abilities and experience vary greatly from one to the next. There are several new franchise companies that recently entered the industry, and you want to make sure youre not hiring a brand new inspector who just bought into the latest franchise. One way to quantify the quality of a home inspector is to contact a national or state association of home inspectors to find out what certifications are required for membership, and if there are any members in your area that they'd recommend. You may also want to ask your real estate Agent for a list of reputable companies theyve worked with in the past.

    An inspection by a qualified inspector should cost between $300 and $500 and give you a good idea of what future repairs will be needed. You can make your purchase contract offer contingent on a favorable inspection and may use the results of the inspection to your advantage. If the home inspection results do not meet your approval, you can get out of the contract if you would like. A great home inspection can not only help you avoid pitfalls, it can also help arm you with items you and your real estate Agent can use to your advantage to negotiate a better deal.

    What the Home Inspection Should Cover

    At a minimum, the home inspector should examine the following:

    Exterior structural components including the foundation, roof, siding, and chimney

    Interior structural components including the basement or crawlspace, attic, flooring, and ceilings

    Major systems including heating, cooling, plumbing, and electrical

    You should make every effort to be present during the home inspection. Keep in mind that the inspector is working for you not the seller or Agent or anyone else. They are on your payroll and should treat you as such. So, dont be shy about walking around and asking questions. This will give you a firsthand look at any problem areas associated with your future home.

    Once the inspection is complete, you should receive a Comprehensive Home Inspection Report with descriptions, and possibly photographs, of any problems with the home. Sometimes, this will be sent to you later in the day, but some inspectors have means of printing a copy for your right on site.

    Travel Insurance for Vacation Rentals

    A family booked a rental cottage last summer, arrived safely and just loved the cottage. However, on the second day of their two week stay, the mom got a call to say her father was seriously ill and not expected to live. The family packed up and returned home, and sadly, her dad died a few days later. After the funeral, the renter called the cottage owner and asked what sort of refund she could expect as they had only used 2 days of their 14 day booking. The owner refused to pay any refund with the explanation that she relied on the cottage rental income to pay the costs of her cottage and it was always fully booked through the season. She was not able to find a replacement rental party at the last minute and as the rental agreement stated; if that was the case no money would be returned. Of course the rental group did not have travel insurance, which would probably have covered trip curtailment due to the illness and/or death of a close relative. The rental cost the family over $4000 and they were not able to recover a penny of that money.

    Many people believe that trip insurance is only necessary if there is a flight involved; where delay, lost baggage, and the risk of the airline going bust, is covered; and medical cover is required in a foreign country. Its not considered important, or not considered at all, to buy insurance to cover a trip taken by road to a self catering property in the same province or the same country.

    Think again! Most cottage bookings are made several months in advance and many things could happen after you have booked to change your circumstances. Illnesses of any member of the traveling party, redundancy or a call to jury service are just a few of the situations that would be covered by a travel insurance policy. A few insurance companies also offer a change of mind clause, allowing you to cancel for any reason after a booking has been made and paid in full. This normally pays out an amount sufficient to cover any cancellation fee the rental agency or owner may apply.

    When you book your vacation rental property, check the property owners or agencies cancellation policies carefully. If it is not clear, ask the question. In general, most private owners and rental agencies will attempt to rebook a property if it is cancelled, and refund your money for the period they have rebooked, less a cancellation fee.

    The premium paid for trip insurance becomes less significant, the more you are paying, however it is worthwhile at any price, for your peace of mind.

    Why Do I Need Disability Insurance

    Your career is a direct result of hard work and a substantial investment of time and money. Doesnt it make sense to fully protect it? A disability could render you helpless by taking away the one thing that you need to safeguard all of your assets: your income.

    Home, auto, life, and health insurance are certainly valuable investments, but failure to couple them with disability insurance will jeopardize your full financial security. For example, health insurance might cover the potential fiscal pitfalls of the medical bills that result from a disability, but the rest of your financial obligations are not going to come to a halt. Vehicle payments, mortgages, insurance premiums, and even savings for the future are all important expenses that cannot be ignored just because you are disabled. Unfortunately, the chances of becoming disabled might be greater than you think.

    According to the 1994 Statistical Abstract of the United States, in the course of a year, odds are that 1 in 10 people between the ages of 25 and 64 will suffer a disability. When comparing that ratio to the odds of being victim of a house fire (1 in 122); injured in an automobile accident (1 in 160); or even of death (1 in 117), the advantage of disability insurance is clear. A February 2000 article in the New York Times reported that 1 in 7 people between the ages of 35 and 60 will become disabled for five years or more.

    Despite these glaring statistics, many people still take a substantial risk by ignoring the benefits offered by a disability insurance policy. In 2000, a survey by The Consumer Federation of America and The American Council of Life Insurers found that 82 percent of people do not have long-term disability insurance or believe their coverage is inadequate.

    The alternatives to disability insurance all carry a degree of risk or have some sort of drawback. Social Security benefits are difficult to qualify for and the disability must prevent you from working in any occupation. Workers compensation benefits are limited and only cover job-related sickness or injury. Other optionsrelying on savings, family, and/or friendsare not guaranteed and have considerable downside.

    Smoke Fire in your Home 7 Things to Clean and Breathe

    Have you ever had a smoke fire in your home? Was it caused by your furnace? Was it caused from another problem? Did you have an immense cleanup at the time? Did you have to vacate your home? Did you have your homeowners insurance company put on boxing gloves and go rounds? If the answer to this question is yes or no, read on.

    After your smoke fire you must vacate your home. If you are lucky your homeowners insurance will come through and pay for your food and lodging while your home is recovering.

    The down side of this is most insurance companies expect you to pay for your food and housing, keep the receipts and will then reimburse you.

    What if you do not have a charge card? What if you are not working and do not have an income? Now what do you do? You cant stay in your home it is unsafe to breathe the air. Another option is to stay with relatives and friends which can become quite a hassle. If you stay in a hotel picture you and your family all jammed into one room without a kitchen. There is absolutely nothing like your own home.

    I AM GOING TO LIST THE FOLLOWING STEPS THAT NEED TO BE TAKEN WHEN YOU HAVE SMOKE DAMAGE IN YOUR HOME:

    (1)You need to thoroughly clean your:

    (a) carpets

    (b) drapes

    (c) clothing

    (d) bedding

    (e) Appliances

    (f) Floors

    (g) pictures

    (h) knick knacks

    (2)The walls will need to be thoroughly washed and in some cases painted.

    IF YOU ARE STILL SENSITIVE TO THE AIR QUALITY OF YOUR HOME AND EXPERIENCE:

    (a)Dizziness

    (b)Light Headed

    (c)Nauseous

    (d)Weak arms and legs

    (e)Elevated Blood Pressure

    INTENSE CLEANING OF YOUR HOME:

    (3) If you have a cottage cheese ceiling - it will have to be stripped to make the ceiling smooth to be able to clean or paint.

    (4) If the carpeting still smells of smoke after steam cleaning - it will need to be removed and replaced.

    (5) The heating and air conditioning ducts will have to be cleaned or replaced. If they are lined with asbestos the asbestos will have to be removed by toxic specialists.

    (6) Replace all your furniture.

    (7) Remove anything and everything that can possible to be trashed.

    Smoke is air born and sticks to every surface of your home. The cleaning is essential either by you or a designated cleaning service that specializes in smoke damage.

    This is a new beginning for you and your new home. This is a long, expensive undertaking. You will be stressed to the max. Stand up to your home owners insurance company. Ask what have I been paying for all these years? In the end you will be back into your own home. Enjoy it.

    Wounded Wolves ---- The Journey Forward

    This is a story about finding your way. Its dedicated to any and all people that may have found themselves lost, confused, powerless, in a dead end career, going nowhere and those who may have lost sight of what they really want from life.

    Its a story about Wounded Wolves and making the journey forward. Forward to success, self esteem and pride. Maybe a few of you can relate to this as its happening now. Or, maybe you were wounded once and remember the journey you had to make to create happiness and success in your life.

    Being wounded can be a result of many things a personal crisis, family life, a bad marriage, the way you were raised, poor life decisions, limited exposure to education and learning, and sometimes just being in the wrong place at the wrong time. It can even be just a matter of heritage and the socialistic environment that you become accustomed to as a child.

    If you find yourself in this type of situation, often times your attitude suffers, you cant seem to make anything work. You lack focus and you often become paranoid. Optimism doesnt exist. In fact, you become very pessimistic and may even create the self-fulfilling prophecy of failure.

    You become disappointed; disappointed in life, disappointed with your job, disappointed with yourself. You begin to dislike what you have become, but you dont really know what to do. You dont know how to change. You may even begin to dislike yourself.

    Okay Stop!!!

    Thats enough with the Doom and Gloom. This isnt about feeling sorry for you. This is about creating The Journey Forward. My very first mentor that took me under his wing at the prime age of 18 years old when I was in the military said these five words to me that I still remember today.

    Never ever ever give up!

    So. Lets start there. No matter what situation you find yourself in, make a pledge right now that no matter how tough the journey seems, you are committed, and you will not give up. Your journey may be simply creating a better career path at your place of employment. It may be starting your own business or it may be as extreme as grabbing yourself by the bootstraps and pulling yourself out of personal devastation. It doesnt matter what circumstance you are in. You can create a path forward if you are committed and you pledge to Never ever ever give up.

    Lets begin discussing your journey forward by reflecting on another journey.

    A number of years ago a 10-year-old boy roamed the streets of Toledo, Ohio. He grew up on those streets learning lifes lessons. Like many of us, he came from a broken home. His daddy left him and his four brothers and one sister when he was five. His dad died when he was nine. He was the youngest, the baby of the family. You can imagine that times were tough; feeding six hungry kids wasnt easy, especially without a father figure. In fact, he was on welfare during his entire adolescent period until he joined the military at age 17.

    At the age of 10 he sold newspapers in downtown Toledo. He crafted his abilities, his drive, on those streets. He didnt have a plan; he didnt have anyone to show him the way. He only had himself, and he had a best friend, a black kid, named Louie Jones. They didnt have a normal paper route like most kids, delivering to the same house every day in nice, quiet neighborhoods. This young boy and his friend, Louie, did what was known as blue jacking and their territory happened to be skid row. They carried a canvas sack filled with the Toledo Blade. The bag weighed almost as much as they did. They went form bar to bar.

    If they couldnt sell a newspaper, theyd shine shoes. If that didnt work, theyd dance to music on the jukebox hoping the drunks and semi-drunks on skid row would throw nickels and dimes at them. In fact, it wasnt Michael Jackson who invented the moonwalk; it was Louie Jones who first did it in a little bar called the Erie Caf in Toledo, Ohio.

    At the time the young man didnt realize what life should be like. He knew he was wounded but he just didnt know how badly. They say ignorance is bliss, well; this young mans ignorance was only of his surroundings. He was quite an entrepreneur and became more successful on the streets as he grew, but he was wounded and heading for trouble. He started his first business at the age of 15 selling used car parts. He would take orders by day and fill them by night.

    You need hubcaps for a 57 Chevy, not a problem; a carburetor for a 55 Ford, youll have it in two days.

    The young man didnt realize how deep his wounds were even though at times he would crouch down and hide behind trash cans and cars as he walked home from school until the rest of the kids were gone so they didnt see him go into that condemned house where they lived on the city dump.

    His wounds could have gone deeper but then a life-changing event occurred, he graduated from high school and, at the age of 17, he had no clue what to do with his life. But he did know what he didnt know. He knew that if he continued on the path he was on he would end up in deep trouble, maybe even prison. In fact a juvenile judge explained that to him with crystal clarity. He knew he needed something to change the direction he was headed in. Something to change the path he was on. He was offered the opportunity to join the military.

    It was during the Vietnam Era and the military trained him in Jungle Survival; not a whole lot of different than the techniques he learned in street survival. Not a whole lot different then the techniques you must learn to be successful in business today. Those four years were filled with defining moments in his life. He had no idea what to do when his four years in the military were up.

    As he left the military his wounds seemed to open a bit. Self-doubt started to creep in until he remembered those words from that old Sergeant.

    Son if you want to really be successful in your life you have to want it so bad that it overcomes all the pain and guilt you have stored in your memory. And remember, Never ever ever give up!

    Different Journeys

    So What.. What does this journey have to do with you and your personal journey? In reality, nothing. Everybodys journey will be different. I only tell this story to let you know that you are not alone. Most people face some sort of crisis at some point in their life.

    Let me share a few principles and guidelines that may help you if you find yourself in any type of difficult situation or you just want to accelerate your journey forward toward success as you define it.

    I. Take Responsibility ---- for who you were, who you are, but more importantly who you want to become. It really doesnt matter how or why you are in the current state you are in. You must take responsibility for it. Until you own it you cant change it. So the very first step is to look within and forgive yourself and relieve yourself of any guilt. People wont start respecting you until you respect yourself. Regardless of your situation, no one but you has the control over changing it. But, you have to want it so bad that it overcomes the pain and the guilt. Do something . Your chance of winning the lottery is extremely remote. Dont create false dreams. Create productive dreams that have a better chance for success. The Law of Attraction only works when you take action. Stop blaming other people or circumstance.

    II. Avoid the Irrational Ghosts ---- Let go of your fears. Change is scary but if you create it, you can control it. Be a little bit of a maverick. Decide to take some calculated risk. Begin to look at all your options. Success principles, and there are hundreds of them, only work if you conquer your fears first.

    III. The Time is Now ---- No change can occur until you do something. The beginning of your journey forward starts with you. You may have an angel looking over you but you must initiate success ---- no one can do it for you. Analyze your life, your career, your dreams and your realities. You need a clear purpose, a purpose that motivates you. Figure out exactly what you want to do with your life and call that your Destination.

    IV. Map the Journey ----- Nobody starts on a journey without some type of direction. You must go forward with focus, passion, and a sense of meaning. Begin by quantifying your goals. How will you measure success? What does succeeding mean to you? For some its just a promotion to upper management. For others it means happiness and spiritual wealth and to others it may mean being the CEO. You define success for your life and only you can do that. Dont let anyone else set your standards for personal life achievements. Outline your purpose. Get off the path you are currently on. Every single one of us at some point in our lives feels stuck. Get unstuck. Start by investing in learning. Commit yourself to at least one hour a day of scheduled reading or other forms of education.

    V. Write Down Your Goals ---- Write down at least three to five goals for your life, under each goal try to identify milestones along the way that can track your progress. And lastly, under each goal identify specific actions that you feel you must take to accomplish that goal. Its amazing how success rates multiply simply by defining goals and putting them in writing. List specific factors in your life that would allow you to generate the best methods in accomplishing your goals.

    VI. Execute ------- Some general once said, No plan survives contact with the enemy. To me that means unless you begin to execute, you will never figure out what adjustments and changes are necessary to keep your journey on track to reach your destination. Remember, youre not alone. Many of us have been wounded in some form or fashion. Even the rich and famous in our society have wounds; some may be even deeper than ours. Begin executing by searching for a coach or mentor that can help you. Someone who has been there and done that. You will be amazed to find out how willing some people are to reach out and help you succeed if you are sincere, dedicated, hard working and willing.

    It is Possible

    This story is heartfelt because it is my personal journey. I am the young man who sold newspapers on skid row. I am the young man who has been inspired for a life time and whose heart holds treasured lessons and memories from the old Sergeant in the military. I Never-ever-ever gave up and I had to learn to forgive! I only reflect on it to let you know I wasnt born with a silver spoon in my mouth. I wasnt a member of the Lucky Sperm club. Although I have the academic credentials, I am not an academic. I didnt complete my formal education in life until I was over fifty years old. But more importantly, I was wounded once and found my way forward. You can too. It may not be easy but its doable.

    RememberSuccess isnt a gift. It just doesnt happen. Like the Wolf --- you must learn to lick your wounds. They will heal. But if you are going to create a journey toward success, you have to plan for it. We all live 24 hours each day. What you do with that time determines your success. Ask yourself if you really have defined your destination. Ask yourself if you have defined the map for your journey. Create a self-imposed respect for time. Learn to multi task. Treat time as an investment.

    If that ten-year-old kid from Toledo who was headed for trouble can make it, so can you. Be a Lead Wolf. Believe in yourself, work hard, be committed and Never ever --- ever --- give up! Thanks for listening; I hope I've opened a door for you that never closes.

    You May Have A Bad Fuel Pump!

    Here is what happened to one of my customers awhile back:

    Stella bought a small pickup, with a window sticker, "As Is!"

    The next day she was driving to town and it died, so she pulled off the road, called the wrecker to tow it to my shop.

    When I turned the ignition to start, the engine cranked up and sang just as smooth as the Blue Bell cow.

    She wanted me to tell her what was wrongI told her I had no idea, as it was running fine, now.

    This happened about every two or three days: each time the wrecker dropped it off, it would crank up and run; and she would ask, "What's wrong? You're the mechanic."

    I told her to call me the next time instead of the wrecker. The only way I was going to be able to find the problem, was to be there when it happened.

    Sure enough, two days later I get a call, "Come crank my truck!"

    When I got there I checked to make sure we were getting fire to the distributor.

    Then I checked to make sure we were getting fuel...no fuel.

    The fuel gauge showed half full.

    I removed the fuel filter; there was no fuel in it.

    I had her crank the engine a couple of times and then fuel started flowing through the line.

    I connected the line to the filter and had her crank it againfuel flowed through the filter.

    I noticed the filter was newThe fuel lines were new.

    Evidently the previous owner had had the same problem.

    On a hunch, I decided to replace the fuel pump.

    Sometimes a fuel pump will just quit pumping, then after it sits awhile, it will go back to work Ive worked with people like that. :-)

    That must have been the problem because it never died on her again until she turned the ignition switch off.

    2. Durable Power of Attorney for Finances

    a. Durable powers of attorney for finances allow someone else to handle your finances for you. They come in two basic types:

    i. A springing durable power of attorney allows your agent to handle your financial affairs (such as paying bills) if you become incapacitated.

    (1) If you regain capacity, your agent loses this power unless and until you become incapacitated again.

    ii. An immediate durable power of attorney goes into effect immediately, regardless of whether you are incapacitated or not.

    (1) This type of power of attorney stays in effect until a specified date is reached, a specified event occurs, or the person who made it revokes it.

    (2) It is often used when a person is losing capacity or when the maker is going to be out of the country for an extended period of time.

    b. If you dont have a durable power of attorney for finances and you become incapacitated, often the only thing your family (or friends) can do is go to court and obtain a conservatorship. This can take months and is very expensive.

    c. Frequently your spouse (or partner) is your primary agent, and then adult children or friends are the successor agents in case your primary (or subsequent) agent is unable (due to incapacity, etc.) or unwilling to act on your behalf.

    d. Powers of attorney expire on the death of the principal (the person giving the power of attorney) so they cannot be used in place of a will or trust.

    3. Advanced Health Care Directive

    a. In California, this used to be known as a durable power of attorney for healthcare.

    b. This is designed to allow your agent to make health-care decisions for you if you are incapacitated.

    c. Unlike with a power of attorney for finances, an advanced health care directive cannot be immediate; instead it must be springing. This makes sense: if the principal has capacity, he/she should be making his/her own health decisions.

    d. An Advanced Health Care Directive also:

    i. Allows your agent to have access to your medical records.

    ii. Gives your agent priority over anyone else in making health decisions for you.

    iii. Allows you to express your desire regarding life-sustaining medical treatment. For example, many people have the document state something like the following:

    It is my express wish and expectation that I not receive life-prolonging medical treatment that merely delays inevitable death if the burdens of treatment outweigh the anticipated benefits.

    iv. Allows you to express your desire regarding organ donations, autopsies and disposition of your remains. (This same information should be placed in the will and/or the trust, since powers of attorney expire on the death of the principal.)

    4. Capacity Issues

    a. Frequently springing durable powers of attorney for finances and advanced health care directives state that two physicians must certify in writing that the principal is incapacitated. Often its difficult to obtain this, since physicians are concerned about liability.

    b. One alternative is say something like the following:

    For purposes of this instrument, I shall be deemed "incapacitated" if certified in writing by any two people falling within the following categories:

    My spouse, if any.

    Any successor trustee to any revocable trust created by me.

    Any actual or potential agent specified in this power of attorney.

    Any actual or potential executor specified in my will.

    The following named persons:

    Any licensed physician not related by blood or marriage me nor to any beneficiaries of any trust or will created by me.

    5. Unified Federal Gift and Estate Tax Credit

    a. There is a Unified Credit against federal gift and estate taxes as follows (based on the net estate):

    b. Individual retirement accounts are counted as part of the net estate.

    i. Where an irrevocable trust holds an insurance policy and is specifically prohibited from exercising any power normally conferred on the owner of a policy, the proceeds of the policy are not counted as part of the estate.

    c. Life insurance proceeds are counted toward the net estate if either i) they are received by the estate or ii) they are received by other beneficiaries and the deceased had any incidents of ownership in the policy.

    d. Note the drop in the Unified Credit between 2010 and 2011. Everyone assumes that Congress will do something about this before 2011, although at the moment some wags refer to 2010 as throw momma from the train year.

    6. Agreements Between Spouses Regarding the Status of Property

    a. Sometimes spouses, as part of estate planning, want to confirm in writing that certain property is community property or separate property.

    b. Such agreements often provide that joint tenancies (which have a right of survivorship) are really community property. This creates a new income tax basis for both halves of the community property on the death of either spouse; joint tenancy assets generally receive a new basis only for the decedents one-half share.

    i. On the other hand, with large estates (in excess of $1.5 million), joint tenancy with right of survivorship may avoid estate taxes since the property does not become part of the deceaseds estate. This, though, has to be weighed against not receiving a new basis for one-half of the property.

    c. Note that since July 1, 2001, the community interest of a husband and wife may be held as community property with right of survivorship. This provides the best of both worlds.

    d. As of January 1, 2005, community property law also applies to domestic partners who have registered with the California Secretary of State.

    i. Registration with counties, cities or employers does not count for this purpose.

    ii. Those who have already registered do not have to re-register unless one of the pair filed to terminate the registration at some point.

    iii. The tax benefits of community property, though, will only apply with respect to California taxes, not federal taxes.

    7. Reason to Have at Least a Will

    a. If you do not have at least a will, then California law determines who receives your estate. This may not be what you want to have happen.

    b. Where someone dies without a will, California will generally distribute the estate as follows:

    i. If there is a surviving spouse, that spouse receives:

    (1) All community property.

    (2) As to the decedents separate property (if any):

    (a) All of it if the decedent did not leave any surviving issue, parent, brother, sister, or issue of a deceased brother or sister.

    (b) One half if the decedent has only one child or has one deceased child with issue.

    (c) One half if the decedent leaves no issue but leaves a parent or parents or leaves their issue or the issue of either of them.

    (d) One-third if the decedent leaves more than one child, leaves one child and the issue of one or more deceased children, or leaves issue of two or more deceased children.

    ii. The rest goes first to the decedents surviving children or, if any of them are deceased, to the childrens surviving issue.

    iii. If the decedent has no surviving children or deceased children with surviving issue, the rest goes to:

    (1) The decedents parents, if living.

    (2) The decedents brothers and sisters (or their issue if any of them are deceased).

    8. Reasons to Have a Trust

    a. Normally, unless a trust has been created, an estate must be probated.

    i. If, though, the gross value of the estate is $100,000 or less (without subtracting any liens, debts, deeds of trust, etc.), there are simple procedures for distributing an estate without using formal probate proceedings.

    ii. In addition, all property that a surviving spouse is entitled to receive may be handled with simplified procedures.

    iii. Even in these two cases, probate still may be appropriate, though, if there are strained family relations, complex investments, large or complex claims by creditors, or an interest in a good-sized business.

    b. There are two problems with probate:

    i. It often takes 8 to 10 months. (It can take even longer.) During that time, if the family needs money from the estate, a motion has to be brought and a court order obtained. In contrast, with a trust, there is no probate and the beneficiaries receive the money immediately.

    ii. Probate is expensive. Attorneys fees are set as follows and are based on the gross estate, meaning that there is no subtraction for any liens, debts, deeds of trust, etc.:

    (1) Four percent on the first one hundred thousand dollars ($100,000).

    (2) Three percent on the next one hundred thousand dollars ($100,000).

    (3) Two percent on the next eight hundred thousand dollars ($800,000).

    (4) One percent on the next nine million dollars ($9,000,000).

    (5) One-half of 1 percent on the next fifteen million dollars ($15,000,000).

    (6) For all amounts above twenty-five million dollars ($25,000,000), a reasonable amount to be determined by the court.

    For example, if your estate is a house worth $700,000, then the probate fees for the attorney will be $17,000 ($4,000 + $3,000 + $10,000) regardless of the size of any loans against the property.

    iii. The executor of a will is also entitled to statutory fees, although the executor can waive those fees if he/she wishes (and family members often do).

    c. A trust can also be used for some tax planning.

    d. A revocable trust can be set up to create, upon the first spouses death, a marital deduction trust (which is usually either a QTIP Trust or a Life Estate with Power of Appointment Trust) and a credit shelter trust (also known as a Remainder Trust, B Trust, or Bypass Trust). The advantage of doing this is that it effectively doubles the Unified Credit.

    e. Complex estates (basically those where the net value of the estate is at least twice the Unified Credit for spouses and equal to the Unified Credit for singles) may also use various irrevocable trusts, certain charitable gifts, generation-skipping trusts, etc.

    i. One example is an irrevocable insurance trust, where an irrevocable trust is made the beneficiary of life insurance policies.

    (1) If insurance is owned by an irrevocable trust, the insured should not serve as trustee.

    ii. Another example is a charitable remainder trust: donating a highly appreciated piece of real property such as a residence to a charity and receiving a charitable donation but retaining the right to remain there for life.

    9. Revocable Trust Assets

    a. For a trust to be effective, most major assets have to be transferred to the trust so that the trust owns them.

    i. With real estate, this means that a deed has to be prepared transferring title to the trust, and then the deed filed with the County Recorders Office.

    ii. With stock brokerage accounts, the brokerage companys forms must be completed. Often the signature has to be confirmed (witnessed) by stock broker.

    iii. With savings accounts, the banks forms must be completed.

    iv. Its usually more trouble than its worth to put cars (unless they are extremely valuable) or day-to-day checking accounts into the trust.

    v. Personal property (jewelry, furniture, artwork, etc.) can be placed in the trust just by mentioning them correctly in the trust document(s).

    vi. Title is generally transferred to the trust by designating the owner along the following lines: John and Mary Smith, Trustees of the 2005 Smith Family Trust.

    b. Ownership of retirement accounts (IRAs, 401(k)s, Keoghs) generally should not be transferred to the trust, because doing so will trigger adverse tax consequences.

    10. Beneficiary Designations

    a. Certain items the proceeds of life insurance policies and survivor rights in retirement accounts usually are not governed by the provisions of a trust or will, since they are contractual arrangements. Instead, one designates the beneficiaries by completing the forms provided when the life insurance policy is taken out or the retirement account is created.

    b. Generally, you can change the beneficiaries at any time by filing out the proper forms.

    i. One exception is with retirement plans. With these, you normally must make your spouse the primary beneficiary unless your spouse signs a written waiver.

    c. The beneficiaries of a life insurance policy generally receive the proceeds free of federal income tax. As noted previously, though, the amount of the proceeds will count toward the net estate for purposes of the Unified Credit if the insured retained any incidents of ownership.

    d. Basically, the only time married individuals should not name each other as primary beneficiaries on life insurance policies and retirement accounts is when their estates (including individually owned life insurance benefits) exceed the Unified Credit (or twice the Unified Credit, if they have the proper type of trust) and would trigger estate taxes. (As noted before, money that survivors receive from individual retirement accounts counts towards the net estate for purposes of the Unified Credit.)

    i. An exception is when the surviving spouse perhaps due to incapacity, ill health or lack of experience in financial matters -- may not have the ability to manage the money. In that case it may be better to designate a trust as the recipient of the life insurance proceeds and survivor benefits of retirement plans.

    e. While spouses who are designated as beneficiaries of retirement plans are usually eligible for a tax-free transfer to an individual retirement account or another pension plan, non-spouse beneficiaries are not.

    i. When the retirement funds are not rolled over, there is income tax, since any time money comes out of a retirement account there is tax.

    ii. On the other hand, retirement plan companies can now spread the retirement plan distributions over the life of the beneficiary minimizing the income-tax impact. As a result, the tax issue here is much less of a problem than before. Contact your company for details.

    f. In any case, contingent, secondary beneficiaries should be named. Otherwise the money may wind up being distributed according to the terms of the trust or will.

    i. Naming minor children as beneficiaries may be a problem, since the money would likely have to be held by a court-appointed guardian. To avoid this, a trust for minors can be named as a contingent beneficiary.

    ii. Another problem is that if you simply name your children as beneficiaries and one predeceases you, that childs children will not receive any money. Again, having a trust named as a contingent beneficiary can avoid this problem.

    11. Family Limited Partnerships and Family LLCs

    a. A family limited partnership or a family LLC is simply a limited partnership or LLC where all the owners are family members.

    b. A transfer of ownership to a child in excess of the $11,000 per person annual gift exclusion will reduce a parents lifetime gift tax exemption (currently $1.5 million) that is permitted under federal estate tax laws. As a result, the value of the ownership transferred to a child is often discounted from a proportional share of the fair market value to get under the $11,000 limit.

    c. There are at least two reasons to justify the discounted value:

    i. There is a substantial value in being able to control a business, and the ownership transferred at any one time is relatively small.

    ii. Because there generally is no public market for the interests in the business, it is often difficult to sell the interests later.

    d. Discounts frequently range from 10% to 50%.

    e. It is crucial that these types of discounts be documented by a supportable appraisal, in case the IRS challenges the discounted values.

    12. How Often Should You Update Your Estate Documents?

    a. Basically, you should consider updating your estate documents when major life events occur:

    i. The births of a baby whom you want to make a beneficiary.

    ii. The death of a beneficiary, agent, executor or successor trustee.

    iii. Divorce.

    iv. A major asset being added or transferred.

    b. In addition, the Health Insurance Portability and Accountability Act (HIPAA) has imposed stringent privacy restrictions regarding medical records. As a result, if your advanced health care directive (or durable power of attorney for health care) does not address the HIPAA requirements, you may want to have it updated.
